2. WEBSITE OWNERSHIP

The AERIDIAN website, including its design, structure, visual identity, written content, graphics, photographs, illustrations, product presentations, videos, animations, logos, trademarks, artwork, software and other materials, is owned by, controlled by, licensed to or lawfully used by AERIDIAN, except where otherwise stated.

Unauthorised copying, reproduction, modification, distribution, publication, commercial exploitation or other unauthorised use of AERIDIAN content is prohibited to the extent permitted by applicable law.

3. AERIDIAN BRAND

The name AERIDIAN, together with its logos, wordmarks, symbols, brand elements, visual identity and associated branding, belongs to or is lawfully used by AERIDIAN.

Nothing on the Website should be interpreted as granting a licence or right to use the AERIDIAN name, logo, trademark or other brand assets without appropriate permission.

Unauthorised use of AERIDIAN branding in a manner that may cause confusion, deception or a false association with AERIDIAN is prohibited.

  • visual concepts;
  • logos;
  • symbols; and
  • other creative elements.

Purchasing a physical AERIDIAN Product does not automatically transfer ownership of the intellectual property embodied in the Product.

The Customer receives ownership of the purchased physical Product subject to applicable law, but not an automatic licence to commercially reproduce, manufacture, distribute or sell copies of the underlying artwork or design.

6. AI-ASSISTED AND AI-GENERATED CONTENT

AERIDIAN uses artificial intelligence ("AI") and AI-assisted tools in certain aspects of its creative and marketing workflow.

AI-assisted or digitally generated tools may be used for:

  • product presentation;
  • marketing imagery;
  • model imagery;
  • backgrounds;
  • visual concepts;
  • promotional graphics;
  • campaign concepts;
  • creative compositions;
  • design development;
  • image enhancement; and
  • other marketing or creative purposes.

The use of AI tools does not mean that all AERIDIAN content is entirely AI-generated.

Certain content may be:

  • fully human-created;
  • AI-assisted;
  • digitally modified;
  • human-edited;
  • composited;
  • photographed;
  • rendered; or
  • created through a combination of these methods.

7. AI-GENERATED MODEL IMAGERY

Certain AERIDIAN promotional images may depict digitally generated or AI-generated models.

Such individuals may not represent real people.

Unless expressly stated otherwise, an AI-generated model appearing in AERIDIAN marketing material should not be interpreted as:

  • a real AERIDIAN employee;
  • a real customer;
  • a real customer testimonial provider;
  • a real celebrity;
  • a real brand ambassador;
  • a real influencer; or
  • another identifiable real person.

AERIDIAN does not intentionally represent a digitally generated individual as a real person where doing so would be misleading.

8. AI-GENERATED PRODUCT PRESENTATIONS

AI-assisted or digitally generated product imagery may be used to demonstrate how a Product may look when worn or presented in a particular environment.

Such images may contain digitally generated:

  • models;

  • backgrounds;
  • props;
  • styling elements; or

Only items expressly identified as included in the Product description or Order are included with the physical Product.

A digitally generated background, model, accessory or environment does not automatically form part of the purchased Product.

9. ACCURACY OF AI-ASSISTED IMAGERY

AI-generated and digitally enhanced imagery may contain reasonable visual differences from physical Products.

Differences may occur in:

  • lighting;
  • shadows;
  • colour;
  • texture;
  • fabric appearance;
  • garment drape;
  • model proportions;
  • background;
  • styling;
  • visual composition; and
  • other visual characteristics.

Customers should review the written Product description, specifications, size chart, material information and other factual Product information when making a purchasing decision.

AERIDIAN will not intentionally use AI-generated imagery to materially misrepresent the nature, quality, quantity, characteristics or other material attributes of a Product.

10. PRODUCT INFORMATION TAKES PRIORITY

Where there is a reasonable difference between a purely visual aspect of an AI-assisted image and the factual Product information provided on the applicable Product page, Customers should rely on the factual Product information, including:

  • Product description;
  • material/fabric information;
  • size chart;
  • fit information;
  • colour name;
  • dimensions where provided;
  • included items;
  • care instructions; and
  • other stated specifications.

Where a Product is materially different from its description or Order, the Customer may contact AERIDIAN in accordance with the applicable Return & Refund Policy.

11. NO MISLEADING REPRESENTATION

AERIDIAN aims to provide accurate and transparent information about its Products.

Nothing in this Legal Notice authorises AERIDIAN to:

  • falsely describe Products;
  • conceal material Product information;
  • make false guarantees;
  • make misleading claims;
  • materially misrepresent Product characteristics; or
  • otherwise engage in conduct prohibited by applicable consumer-protection law.

Indian consumer-protection law specifically addresses misleading advertisements and representations that may mislead consumers regarding the nature, substance, quantity or quality of a product or service.

Measurements may have reasonable manufacturing tolerances.

A customer's individual perception of fit may differ depending on:

Where the wrong size is supplied by AERIDIAN or the Product materially fails to correspond with its stated size information, the Customer may contact AERIDIAN under the applicable Return & Refund Policy.

AERIDIAN makes reasonable efforts to keep Website content accurate and current.

However, the Website may occasionally contain:

  • technical errors;

  • pricing errors;
  • inventory errors;
